Re: Calling all family law experts

I went through this myself about 9 years ago. My ex partner and I were good friends. I met someone new. It was fine. She met someone new, he was controlling and stopped me from seeing my little one for 3 months.
I went to see a Solicitor for a free 45 minute consultation. This guy was honest and told me that given my plan, I could represent myself in Court. If I wanted him to 'hold my hand' it would cost me north of £10k.
I opted to represent myself with thanks to the honesty of the solicitor. I now have 50/50 shared care.
If your son is confident and articulate enough, he can represent himself.

Hi mate, feel for you and your family. Horrible thing to go through, talking from experience. Courts are corrupt as fuck and many times there’s no reasoning with these mothers once they realise they hold all the strings. Anyway…..
The first step is pay for mediation, just Google it your find it. From memory costs anywhere up to about £500. Basically both parents will be called to a meeting to discuss if you can come to an agreement for the sake of the child. If the mother don’t turn up or refuse, you then pay for a C100 which costs about £200. The court case might take a good few months to be heard, but your go in front of a judge to try and work out a deal and come up with a child arrangements order just beware this is when things can get really nasty and if she gets a solictor probably for free they will come up with all sorts of bollox and accusations to try and stop this. Tell your son be very careful contacting from now on and put everything in writing.
I got a very good legal firm who are all about getting the best for dads, happy to pass details over. Best of luck

It's your son who needs to take action if he is not being allowed to have contact with his child. Grandparents have no automatic right to apply for contact; they will need to apply for leave of the court to do so. But be wary of jumping into legal (court) action too quickly, if there is a chance of the mother and father sorting it out themselves (probably via solicitors) once the dust settles. Family issues are very emotional and going to court could stop or delay all idea of compromise.

Absolutely - and there is also a point when you have o accept you have done your best as a parent and it’s your son’s life to take responsibility for.

I probably spent upwards of £20k to have access to my children 15+ years ago.
Ended up in court with a contested case and had to have a barrister representing me, case was listed for one day, went to the third day 😞
Sad times.
Good luck 🤞

Re: Calling all family law experts

Best case scenario for your son is to try and sort it with the ex regarding access. The reason being courts still fall heavily in favour for the mum. I was advised by a solicitor to do this despite him being offered all the money. I know fathers for justice have 2 different services they offer as I looked into them before I tried the making amends thing with my ex. They will look at your case and give some advice and a consultation for anything up to 900 depending on the level of interaction but then they also offer a full service where they take your case on fully. This was in region of 3k if memory serves me.correctly.
I know what your son is going through and I really.feel for him.and hope you get some good news.soon

Toms, sorry mate caught me at a bad time, too much stress going on.
Joe, thanks. I know grandparents have no rights but she’s lived 50% with my son for a year and he more than provides so he doesnt’t deserved his daughter being held to ransom for more money
Debs, cheers .
I think we’ll have to sort something out through court as this isn’t the first time it’s happened but for now I’m gonna bite the bullet despite telling my son not to cave in to her demands

Hello Mace. I think Joe might be right on this, however to save yourselves a heap of money I'd suggest a visit to.your local Citizens Advice Bureau. They will tell you what options are available, but better still many have agreements with local.solicitors who sometimes offer a short free appointment ( usually about half an hour) for initial advice .
Good luck with it .

Dunno if the law has changed but grandparents have zero rights by law.
When my daughter was born the only ‘right’ I had was to pay for her.
Not a thing else.

Sorry to hear this Mace and sorry you've got to legal measures.
I've no advice beyond try one of the larger / national solicitor firms
They won't want to turn you down and at least you get the ball rolling.
It'll cost...
